3. How to file a DMCA takedown notice

4. Counter-notification (if your content was removed)

If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notice must include:

  1. Your full legal name, postal address, telephone number, and email address.
  2. Identification of the content that was removed and the URL(s) where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. A statement consenting to the jurisdiction of the federal court (if you are located in the United States) or, if located elsewhere, to an appropriate local jurisdiction, and that you will accept service of process from the person who provided the original DMCA notice.
  5. Your electronic or physical signature.

5. Our response process

  • We will review all valid DMCA notices and counter-notifications promptly.
  • If a proper DMCA notice is received, we may remove or disable access to the allegedly infringing content.
  • If a valid counter-notification is received, we may restore the content after the required waiting period unless the complainant files a court action to restrain the alleged infringer.
  • We may also notify the affected parties and forward relevant correspondence to them.

6. Repeat infringers

CarUpdates24 reserves the right to suspend or terminate the accounts or access of users who are found to be repeat infringers of copyright.

7. International rights & legal compliance

  • While the DMCA is a U.S. statute, CarUpdates24 respects intellectual property rights worldwide and will handle valid copyright complaints consistent with applicable law.
  • If you are outside the U.S. and need guidance about local procedures, please include jurisdiction information in your notice.
